Amplify Registration Terms and Conditions

These Amplify Registration Terms and Conditions (“Terms”) are an agreement between Amplitude, Inc. (“Amplitude”) and you or the entity you represent (“you”). By registering for or participating in the Amplify conference (“Conference”), you confirm that you have read, understand and agree to these Terms.

1. Registration

To register for the Conference, you must complete the Conference registration process on the Conference website, purchase a ticket, and pay all required fees prior to the deadlines described on the Conference registration page. Tickets and registrations are subject to availability.

2. Payment

The payment for the tickets must be made via credit card at the time you register for the Conference. All ticket sales are non-refundable and non-cancelable.

3. Transfers and Badge Policy

Substitutions of Conference registrations may be made at any time by contacting amplitude at amplify@amplitude.com. In that email, you must provide the following information about for the new Conference participant: (i) first and last name; (ii) job title; (iii) email address; and (iv) phone number. All “no shows” will be deemed a cancellation by you if you do not show up to the Conference. Amplitude will not provide any refunds to you if you do not show up to the Conference. Amplitude will issue the badge to the person named in the registration. Amplitude may require a photo ID for each participant when collecting a badge at the Conference. Your badge must be worn at all times during the Conference. The badge guarantees admission to the Conference but may not guarantee admission to every session, meeting area, dinners, or other hosted events. Badges may not be shared by participants.

4. Conference Program and Cancellation by Us

The Conference program, including guest speakers and topics, is subject to change. Amplitude may cancel the Conference at any time and may deny or cancel a registration for the Conference (including a confirmed registration) at any time. Amplitude is not responsible for any damages, direct or indirect, resulting from such cancellation. If Amplitude cancels the Conference, Amplitude will issue you a full refund of the ticket fee that you have paid to Amplitude.

5. Code of Conduct

You agree to behave in such a way as to create a safe, supportive learning environment while at the Conference and any related events. You agree not to engage in disruptive speech or behavior or otherwise interfere with the Conference or other individuals’ participation in the Conference. You will comply with all applicable laws and agree not to engage in any form of harassing, offensive, discriminatory or threatening speech or behavior, including relating to race, gender, sexual orientation, religion or disability. Amplitude may, in its sole discretion, as participants to leave the Conference or related events immediately if a participant engages in any behavior that violates this Section 5. Amplitude will not be responsible for providing a refund of any fees paid by you, if you are asked to leave the Conference or a related event due to violating the Code of Conduct described in this Section 5.

6. Information About You; Badge Scanning

Any contact details and other information that you provide to Amplitude at the time you register for the Conference will be will be handled in accordance with Amplitude’s Privacy Policy (https://amplitude.com/privacy). By registering for the Conference and providing your contact details or other information to Amplitude, you consent to the collection, use and disclosure of the information you provide in connection with the Conference by Amplitude in accordance with our Privacy Policy. You can always unsubscribe from receiving our promotional emails at any time by clicking the unsubscribe link in those emails. During the Conference, Amplitude will use a handheld badge scanning technology. The scanning of your badge is optional and you may refuse to have your badge scanned at booths as well as at the entrance to sessions and other events.

Amplitude may also provide your contact information to third-party Conference sponsors if (a) you elect to attend any sessions or other activities at the Conference hosted by Conference sponsors, or (b) you scan your participant badge using a scanner at the Conference sponsor’s booth. The Conference sponsor’s may do their own badge scanning at the Conference and Amplitude is not responsible for Conference sponsor scanning. When a Conference sponsor scans your badge, your consenting to the Conference sponsor to collect your contact information associated with your participant badge, and to communicate with you regarding their products and services in accordance with their respective privacy policies. To opt-out of receiving these communications, please email the relevant Conference sponsor. Badge scanning by a Conference sponsor is optional and you may refuse to have your badge scanned by the Conference sponsor.

7. Use of Multimedia; Materials

During the Conference, Amplitude or its third party vendors may make still photographs and audio and video recordings of you and other participants at the Conference. You hereby grant Amplitude and its affiliates, agents, employees and assigns an irrevocable, nonexclusive, perpetual, worldwide, royalty-free right and license to reproduce, edit, publish, create derivatives of, distribute, publicly perform or publicly display, for advertising, publicity and promotional purposes or for any other purpose in Amplitude’s sole discretion such audio and video recordings and photographs of you, your voice or likeness in connection with the Conference, including your name and biographical information (collectively, “Images”). In addition, you hereby grant Amplitude and its affiliates, agents, employees and assigns an irrevocable, nonexclusive, perpetual, worldwide, royalty-free right and license to reproduce, edit, publish, create derivatives of, distribute, publicly perform or publicly display, for advertising, publicity and promotional purposes or for any other purpose in Amplitude’s sole discretion any materials (electronic or hard copy) created, submitted or presented by you in connection with the Conference, including any materials submitted via social media handles associated with the Conference (collectively, “Materials”). You consent to Amplitude’s use of your Images and Materials in perpetuity without compensation, attribution or additional consents from you, and you waive any moral rights you may have in the Images and Materials.

8. Alcohol

Alcohol may be available at the Conference and dinners associated with the Conference. The consumption of alcoholic beverages is prohibited for anyone under the age of 21. You must be 21 years of age or older to consume alcoholic beverages. Upon request, the participant must provide proof of age.

9. Assumption of Risk

You acknowledge and agree that your attendance and participation in the Conference is voluntary. You agree to assume the risks associated with attending and participating in the Conference to the fullest extent permitted under applicable law.

10. Release of Claims

To the extent permissible by applicable law, you (for yourself, your heirs, personal representatives, assigns, and anyone else who might make a claim on your behalf) hereby release Amplitude and its affiliates, and their respective directors, officers, employees, contractors, representatives, agents, successors and assigns, from any and all claims, demands, causes of action, suits, damages, losses, debts, liabilities, costs and expenses (including without limitation reasonable attorneys’ fees and costs) that you may have now or in the future associated in any way with the Conference, Images, or Materials.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL AMPLITUDE BE LIABLE TO YOU, ANY ENTITY, OR ANY PARTICIPANT FOR ANY PERSONAL INJURY OR DAMAGES TO PROPERTY, LOSS OF DATA, LOSS OF PROFITS, LOSS OF OPPORTUNITY OR OTHER PECUNIARY LOSS, COST OF COVER OR OTHER SPECIAL, INCIDENTAL, CONSEQUENTIAL, INDIRECT, PUNITIVE, EXEMPLARY OR RELIANCE DAMAGES ARISING FROM OR RELATED TO THE CONFERENCE, INCLUDING ANY PARTICIPANT’S USE OF THE BADGE AND/OR PARTICIPATION IN THE CONFERENCE. IN ADDITION, AMPLITUDE’S AGGREGATE LIABILITY FOR ALL OTHER DAMAGES IN CONNECTION WITH THE CONFERENCE SHALL NOT EXCEED $500 USD.

12. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AMPLITUDE PROVIDES THE CONFERENCE, AND ALL SERVICES AND PRODUCTS PROVIDED IN CONNECTION WITH THE CONFERENCE ON AN “AS IS” BASIS WITHOUT ANY WARRANTY OF ANY KIND, INCLUDING EXPRESS OR IMPLIED, OR OTHERWISE. AMPLITUDE EXPRESSLY DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, INCLUDING, BUT NOT LIMITED TO, SAFETY, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

13. Indemnification

Each participant shall indemnify, defend, and hold harmless Amplitude and its officers, directors, employees, agents, successors, and assigns from and against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including reasonable attorneys’ fees, the cost of enforcing any right to indemnification hereunder, and the cost of pursuing any insurance providers (collectively, “Losses”), resulting from any claim, suit, action, or proceeding (each, an “Action”) arising out of or related to: the Conference, a participant’s attendance at the Conference or any participant’s violation of these Terms or other applicable laws.

14. Miscellaneous

These Terms are governed by and construed in accordance with the internal laws of the State of California without giving effect to any choice or conflict of law provision. Any legal suit, action, or proceeding arising out of or related to these Terms or the licenses granted hereunder shall be instituted exclusively in the federal courts of the United States or the courts of the State of California in each case located in the city of San Francisco and County of San Francisco, and each party irrevocably submits to the exclusive jurisdiction of such courts in any such suit, action, or proceeding. Service of process, summons, notice, or other document by mail to such party’s address set forth herein shall be effective service of process for any suit, action, or other proceeding brought in any such court. If any provision of these Terms is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of these Terms or invalidate or render unenforceable such term or provision. Amplitude reserves the right to modify these Terms at any time, in its sole discretion. Your participation at the Conference will be deemed your acceptance of the modified Terms.

15. Emerging Product Leader Awards

ELIGIBILITY

The Emerging Product Leaders Awards is open to all individuals and teams in the product, growth and analytics space worldwide.

A submission is made in one of the 4 categories listed above. There is no limit to the number of submissions that may be submitted by any nominator. A completed Typeform submission form must accompany each entry.

The nominator must have a valid company email address to enter.

UNACCEPTABLE MATERIAL

Submissions that contain pornographic material, propagate “hate” messages, make defamatory statements, or which are otherwise extraordinarily offensive are not eligible.

DISQUALIFICATION

Ineligible submissions may be disqualified at any phase of the without notification.

ACKNOWLEDGMENT OF SUBMISSIONS

All work must be submitted through the Emerging Product Leader Awards submission form. Entries will not be accepted via email or other channels unless announced otherwise via the official Amplify website or technical difficulties prevent Typeform from receiving submissions.

Nominators will receive a Typeform confirmation message and an email when a submission has been received.

Submissions will not be returned.

SELECTION CRITERIA

Applications will be evaluated on the quality and relevance of the submission by qualified judges in the growth and product community.

Applications will be judged anonymously

Selection will not be based on use or knowledge of Amplitude the product or any of its technology partners.

Selection is agnostic to any tools or analysis methodologies mentioned in the submission.

Final winners for each category will be notified via email on or following September 21, 2018, followed by social media announcements on the day of Amplify, October 9.

TERMS AND CONDITIONS

Nominator is responsible for knowing whether the content they share about their nominee is allowed to be shared. Amplitude is not responsible for this.

You are not allowed to upload and distribute any document which is confidential, defamatory, obscene, breaking personal privacy regulations, or infringing copyright and intellectual property rights. We reserve the right to delete any offending material and remove the entries from the Awards.

Nominators are responsible for the legality, originality and copyright of the work submitted in his/her name.

Amplitude will not make any content in the submission public without the nominee’s permission.

PRIZES

Winners will receive a seat at the VIP dinner with our guest speakers on October 8th, recognition on-stage at Amplify on October 9th in front of the product and growth community, and a spotlight blog post on Amplitude’s blog.

Winners are required to acknowledge winning of the prize within 1 week of the notice of winning the award

Winners are to provide their own transportation and accommodation to and from to Amplify. In the case that the winner cannot attend Amplify, they will still be eligible to accept the prize and be featured on the Amplitude blog.

Prizes are non-transferable.
